System abuse is strictly prohibited. Triton.net may terminate service immediately, hold you financially liable for any damages, and if applicable, bring legal action against you under the statues of felony vandalism, if you engage in system abuse. All accounts are single user accounts unless stated differently!
Following is a list of actions that are defined as system abuse. This list is non-exclusive; any action about which there is any doubt should be referred to Triton.net for evaluation.
Actions which constitute system abuse include, but are not limited to:
- attempting to circumvent user authentication or security of any host, network, or account on Triton.net systems or the Internet at large (“cracking” or “hacking”);
- attempting, in any way, to interfere with or deny service to any user or any host on the Internet; forging email or USENET posting header information; trading, distributing or storage of licensed software (“warez”) sending large numbers of unsolicited mail messages (i.e. “junk mail” or “spamming”); forwarding or posting “chain letters” (multiple forwarding) of any type; posting inappropriate messages to USENET newsgroups e.g., posting large numbers of unsolicited posts indiscriminately (“spamming”), or posting encoded binary files to USENET newsgroups not specifically named for that purpose;
- attempting to cancel, supersede, or otherwise interfere with email or USENET posts other than one’s own; engaging in harassment, whether through language, frequency, or size of messages; using an account at another provider to promote a Triton.net Web site in an abusive manner; using a Triton.net account to collect replies to messages sent from another provider which violate these rules or those of that provider. using programs such as “Ponger” in order to keep your connection alive by sending packages every (X) minutes while actually being idle. It is also to be understood that when the customer connects to Triton through the phone numbers, the customer has verified with their local phone company that this number is in fact local. Triton is not responsible for long distance charges the customer incurs as a part of connecting to Triton.
You may cancel your Account at any time. If you cancel your Account within the first 30 days and if you request a refund, we will refund all payments you have made to date; provided however, that you may cancel your Account and receive a refund as provided ONLY ONE TIME ever. Such refunds will be made by issuing a credit to your credit card or, if you have paid by check or money order, by check. Otherwise all payments are non-refundable. To clear up any doubt, if you cancel your Account within the first 30 days and request and receive a refund, and then try to cancel any subsequent Account within the first 30 days of such Account, you will NOT be eligible for any refund payments .
We may terminate your Account (and delete all information related to your Account) immediately if we are not paid in advance or if you breach this agreement. In either case, no refund will be paid. We may also terminate your Account if we decide, in our sole discretion, to discontinue offering accounts, in which event we will pay a pro-rate refund. You may not transfer or share your Account with anyone. You may not disclose your password to any third parties. There may be an additional charge to reissue lost passwords. DO NOT use automated unattended news posting and retrieval programs with our service. Improper use of these automated unattended posting and retrieval news programs can result in termination of your account or interruption of service without notice. We will be disabling accounts of any customers that abuse the system with these (or other) commercial, automated unattended news posting and retrieval program.
Triton Usenet account services are designed and priced for individual use and NOT for commercial level archiving of gigabytes of data. Your individual account is for personal, non commercial use — NOT for archiving, newsfeeding, news sucking, or testing experimental software. You understand that we are providing you with unfiltered access to Internet. We cannot, nor do we try to, control the content that you will receive. By its very nature, the Internet may carry offensive, harmful or inaccurate material, in some cases in postings that have been mislabeled or are otherwise deceptive. We expect that you will use caution–and common sense–when using the Internet. Furthermore, you shall comply with all applicable laws regarding your access to your Account. Notwithstanding the foregoing, Triton may adjust the Usenet groups carried by it at any time in its sole discretion. TTI will not issue credits or suspend billing for periods of non-use such as, but not limited to, vacations, computer problems, or temporary residency. Triton will make best efforts to make its network available at all times. Since certain factors are beyond our control, Triton makes no guarantee of accessibility to its networks, especially during peak usage.
Triton’s liability for any customer claim will not exceed one month of service or $19.95 , whichever is less. Any credits will be issued as additional service and not as cash.
